The doctrine of "judicial review" was made out of whole cloth. John Marshall, appointed by his friend and political ally Adams just made that power up to thwart Jefferson after he pulled the presidency out from under Adams.
Now instead of a neutral court to hear cases of original jurisdiction dispassionately, we have a 9-seat super-senate with lifetime tenure that gets to decide what the real laws are after our elected reps finish playing at legislating 🤦♀️
@incognitum apparently israel is having a similar problem. they don't have a constitution (?) so their black robe god kings just decide if they feel like overthrowing the legislature on any given day.
a law was passed to restrict this and they (unsurprisingly) just said no we're the god kings fuck you.
i'm not sure if people like that realize execution is what comes next, but :cirno_shrug: history tends to show that when all the nice ways of removing authority are suppressed the violent ones follow.
